1. General Provisions
These Terms of Service govern the rules and conditions for using the Łowik.pl mobile application (hereinafter referred to as the "Application") designed for devices running the Android and iOS operating systems.
By installing, registering an account, or using the Application, you accept the conditions outlined in these Terms and the Privacy Policy in full. Account registration in the Application constitutes acceptance of the Terms and Privacy Policy. If you do not agree to these terms, you must immediately stop using the Application and uninstall it from your device.
2. Scope of Services and Features
Łowik.pl is a mobile assistant for anglers, offering features such as a digital catch log, an interactive fish encyclopedia (RyboDex), weather and bite forecasts, and a fishing gear organizer. The Developer reserves the right to modify, add, or remove features of the Application in subsequent updates.
3. Data Collection and Required Permissions
For the Application to function properly, it requires access to certain device features and processes the following data:
- Camera Access: Required solely to use the Łowik AI / RyboDex AI scanner function to take photos of fish for analysis and automatic species identification.
- GPS Location Access: Required to automatically retrieve localized weather data, calculate fish bite forecasts, and filter or display nearby fishing events (such as tournaments).
- Firebase Account Data: The Application supports user registration and login. Credentials (such as email address and unique user ID) are processed to synchronize your catch journal and gear lists in the Firestore cloud database.
4. Third-Party Services
The Application utilizes third-party service providers to deliver key features and handle in-app advertising:
- Google Play Services & Apple App Store Services: Required for the distribution of the Application, installation services, and proper functionality on Android and iOS.
- Google AdMob: Advertising service used to display ads within the Application. AdMob processes data for advertising purposes in compliance with GDPR requirements, based on consents gathered via the CMP dialog.
- Firebase (Google Cloud Platform): Handles user authentication (Firebase Authentication) and securely stores catch logs and gear lists in the cloud database (Firestore).
- Łowik AI (Google Gemini API): The "Łowik AI" artificial intelligence features (fish scanning and identification with RyboDex, and generating tactical recommendations in the forecast) are technically powered by the AI models of the provider Google (Gemini API). The rules for processing photos and data are described in the Privacy Policy.
- RevenueCat (RevenueCat Inc.): Handling and verification of Premium purchases and subscriptions.
- Resend (Resend Inc.): Sending emails (including address verification and notifications).
- WeatherAPI.com and Mapbox (Mapbox Inc.): Providing weather forecast data and displaying maps.
5. Premium Features and Payments
- The Application offers paid features under the "Premium" service, consisting primarily of an ad-free experience (disabling the ads displayed in the Application).
- Premium is purchased as an auto-renewing subscription and is provided and billed exclusively through the Apple App Store or Google Play. The current price is presented in the Application before purchase.
- The subscription is automatically renewed for a subsequent period unless it is cancelled at least 24 hours before the end of the current period. The renewal fee is charged within the last 24 hours of the billing period.
- You may cancel the subscription at any time in your Apple ID (App Store) or Google Play account settings. Cancellation stops future renewals; access to Premium continues until the end of the paid period.
- Refunds and payment complaints are handled in accordance with the rules of the Apple App Store or Google Play respectively, as these entities process the transaction.
- Right of withdrawal: by consenting to the immediate provision of digital content (Premium features) before the withdrawal period expires, you acknowledge the loss of the right to withdraw from the contract in accordance with Art. 38(13) of the Polish Consumer Rights Act.
- We use the provider RevenueCat Inc. to handle and verify purchases.
6. User Content
- In the Application you can save your own content: fish photos, notes, catch log data, and report fishing events.
- By posting content, you declare that you have the rights to it and that it does not violate the law or the rights of third parties.
- Reported content (e.g., event submissions) may be verified before publication. We reserve the right to remove content that violates the law or these Terms.
- Photos submitted to the fish recognition feature are processed by the AI provider in accordance with the Privacy Policy.
7. Advertising and Artificial Intelligence
The Application is funded in part by ads displayed through Google AdMob. Access to some features may require watching a rewarded ad.
Recommendations and results generated by the artificial intelligence features ("Łowik AI", RyboDex) are for informational purposes only and do not constitute a guarantee — the Developer is not liable for decisions made on their basis.
8. Account and Data Deletion
Users have the right to request the deletion of their personal data and account created in the Application at any time. You can delete your account yourself in the Application (Settings → Delete user account) or by contacting us via email. Detailed instructions are available at lowik.pl/account-deletion.
To request the deletion of your account and all associated data from Firestore and Firebase Authentication, please send an email to: dominik-chabro@wp.pl.
Your data will be deleted from the servers within 14 days of receiving the request. Data stored solely in the local memory of the device will be deleted automatically when you uninstall the Application.
9. User Responsibilities and Liability
- The user agrees to use the Application in compliance with the law, these Terms, and social norms.
- The information in the fish atlas (RyboDex) and regulation summaries is for informational and educational purposes only. Although the developer makes every effort to keep this data updated, the angler is solely responsible for verifying and complying with PZW and RAPR regulations on their fishing site.
- The developer is not responsible for any fishing failures or incorrect indications of the artificial intelligence features.
10. Changes to the Terms
These Terms may be updated periodically. Users will be informed of any changes via this webpage or in-app notifications.
